HIVACY END USER LICENSE AGREEMENT
This End User License Agreement ("Agreement") is between you and hivacy ("we", "us"), the developer of Hivacy ("the Software").
By installing or using the Software, you agree to these terms. If you do not agree, do not install or use the Software.
1. LICENSE GRANT
We grant you a personal, non-exclusive, non-transferable license to install and use the Software on devices you own or control,
for your own personal or internal business use.
The Software is offered in a free version and a paid version. The free version provides automatic webcam motion detection
and screen hiding using Show Desktop (Win+D). A paid license additionally unlocks the alternative hide actions and the
adjustable detection sensitivity. Paid licenses are sold as a one-time purchase and are licensed to you, not sold.
2. RESTRICTIONS
You may not:
(a) reverse engineer, decompile, or disassemble the Software, except to the extent this restriction is prohibited by applicable law;
(b) rent, lease, sublicense, resell, or distribute the Software;
(c) remove or alter any copyright or proprietary notices;
(d) share, publish, or resell a paid license key, or circumvent license validation.
3. PERMITTED USE — IMPORTANT
The Software is a personal privacy tool intended to protect the screen of the person operating the computer.
You may only use the Software on a device you own or are authorized to use, and only with a camera you are authorized to operate.
You may not use the Software to monitor, record, observe, or gather information about any other person, or in any manner that violates the privacy rights of
others or any applicable law. The Software has no recording, storage, transmission, or remote access capability and is not designed or intended for
surveillance of any kind.
4. PRIVACY AND CAMERA DATA
The Software requires access to a camera in order to detect motion. Camera frames are compared in local memory to detect movement and are then discarded.
No video or still image is recorded, written to disk, or transmitted to us or to any third party. The Software performs no facial recognition, identification, or biometric
processing.
Our handling of information is described in our Privacy Policy at https://hivacy.com/privacy_policy, which forms part of this Agreement.
5. NO GUARANTEE OF DETECTION — PLEASE READ
The Software detects motion within the camera's field of view using frame-to-frame comparison. Its effectiveness depends on lighting, camera
placement, field of view, the configured sensitivity, the exclusion zones you define, and whether detection has been started and is currently active.
The Software may fail to detect motion, may detect motion that is not relevant, or may not react in time. You must not rely on the Software as your sole means of
protecting sensitive information, and you remain solely responsible for what is displayed on your screen. The Software does not encrypt, lock, or otherwise
secure your data, files, or accounts.
6. UPDATES
We may provide updates, and this Agreement applies to any update unless the update is accompanied by separate terms.
7. TERM AND TERMINATION
This Agreement applies until terminated. It terminates automatically if you breach it. You may terminate it at any time by uninstalling the Software. A paid
license may be terminated if it is obtained fraudulently, shared, or if a chargeback is issued.
8. DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED,
INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR
NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED,
ERROR-FREE, OR THAT IT WILL DETECT ANY PARTICULAR EVENT.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, PRIVACY, REPUTATION, OR GOODWILL, ARISING OUT OF OR RELATING TO
YOUR USE OF OR INABILITY TO USE THE SOFTWARE, INCLUDING ANY CONSEQUENCE OF THE
SOFTWARE FAILING TO HIDE YOUR SCREEN.
OUR TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE AMOUNT
YOU PAID FOR THE SOFTWARE, OR USD 10 IF YOU USE THE FREE VERSION.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.
Nothing in this Agreement limits any rights you have as a consumer that cannot be waived under the law of your country of residence.
10. REFUNDS
Purchases made through the Microsoft Store are subject to the Microsoft Store refund policy.
Purchases made through our website are handled by our payment processor; contact us at [bethemasterkey@gmail.com] and we will help.
11. THIRD-PARTY COMPONENTS
The Software includes open source components, including the Electron framework and its dependencies, which are licensed under their own terms.
Those terms govern your use of those components.
12. GOVERNING LAW
This Agreement is governed by the laws of the Republic of Korea, without regard to its conflict of law rules,
except where the mandatory consumer protection law of your country of residence provides otherwise.
