Legal Notice & Disclaimer
Operator: Hivacy Team
Contact: bethemasterkey@gmail.com
Effective Date: October 16, 2025
Plain-language notes are included in parentheses to help first-time readers.
This Notice complements, and does not replace, our Terms of Service and Privacy Policy.
1) Overview (What this page does)
This Legal Notice & Disclaimer explains how Hivacy uses your webcam (camera attached to your computer), what data the app handles, what permissions it needs, and important limitations of the software.
2) Webcam Usage Notice
Hivacy uses your device’s webcam to detect motion (changes in the video image) in real time.
All video analysis occurs on-device (processed locally on your computer).
No webcam video or images are uploaded to Hivacy servers.
3) No Personal/Video Data Collection (with narrow technical exceptions)
Hivacy does not collect, store, or transmit your personal, biometric, location, or video data.
Core app functions can work offline. However, certain features may require internet temporarily (e.g., payment, license activation, updates, email support).
If any minimal technical information is processed for payment/licensing (e.g., license key status), it is handled by trusted providers and described in the Privacy Policy.
4) System Control Notification (Hotkeys & automatic actions)
When motion is detected, Hivacy may automatically trigger Alt+Tab and/or system mute, and other actions you enable.
These actions can cause unintended screen switches or audio changes if triggered unexpectedly.
You are responsible for choosing sensible settings and testing them in your environment.
5) Intended Use & Misuse Prohibition
Hivacy is a supplemental privacy tool for personal productivity and privacy protection.
It is not a surveillance tool and must not be used for unlawful monitoring, unauthorized recording, or invading others’ privacy.
You must comply with all applicable laws, workplace/school policies, and building rules where you use the app.
6) Safety-Critical / Sensitive Environments
Do not rely on Hivacy in safety-critical contexts (e.g., medical, life-support, critical infrastructure, aviation).
Do not use the app to bypass security controls or to hide unlawful activities.
Always maintain manual control and backup options for your tasks.
7) Permissions Disclosure (OS-level access)
Camera (Webcam): required to detect motion; analysis stays local (no upload).
Accessibility/Input: used to simulate hotkeys (e.g., Alt+Tab, mute) that you enable.
You can revoke permissions anytime in your OS settings; some features may then be limited.
For step-by-step OS instructions, see our Accessibility & Permissions Notice.
8) Open-Source & Third-Party Components
Hivacy includes open-source components such as OpenCV.js (computer-vision library in JavaScript).
All components comply with their respective licenses; see the in-app Open-Source Notices page or project documentation.
Hivacy may use trusted providers (e.g., Paddle for payments, Keygen for license management, SendGrid for support emails, Render for hosting). Their own terms/policies apply where relevant.
9) No Warranty (As-Is)
The software is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind—express, implied, or statutory—including, but not limited to, merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted/error-free operation.
Performance can vary based on your OS, hardware, drivers, and security settings.
10) Limitation of Liability (General)
To the maximum extent permitted by law, Hivacy Team and its suppliers shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or for loss of data, work interruption, lost profits, or device/software issues arising out of or related to your use of the software.
Where liability cannot be excluded, it is limited to the amount you paid for Hivacy during the preceding three (3) months (if any). Some regions do not allow certain limitations; your statutory rights remain.
11) User Responsibilities (Plain-language summary)
Configure Hivacy carefully and test before using it in public, shared, or sensitive spaces.
Keep your OS and security software up to date.
Use strong passwords and screen locks; Hivacy is not a substitute for fundamental security practices.
Respect others’ privacy and local regulations at all times.
12) U.S.-Specific Disclosures (including California)
Liability: The above Limitation of Liability applies to the fullest extent permitted by U.S. law.
California Consumer Privacy (CCPA/CPRA): Hivacy does not “sell” or “share” personal information and does not process biometric/video data. If you are a California resident, you may contact us to exercise rights under state law; if we do not process personal data, there may be no records to provide.
Misuse: Use solely for lawful personal productivity and privacy. All misuse is prohibited.
13) EU/UK-Specific Disclosures (GDPR)
Controller: Hivacy Team (replace with your registered entity once available).
Legal bases: We rely on performance of a contract (to provide the app), legitimate interests (security, improvement), and consent (only where required, e.g., optional analytics on the website).
Data minimization: Core processing is on-device; payment/licensing uses trusted processors.
Transfers: Where international transfers occur (e.g., for payment or licensing), we implement safeguards such as SCCs.
See the Privacy Policy for detailed rights (access, rectification, erasure, restriction, objection, portability).
14) Korea-Specific Disclosures (PIPA)
Hivacy follows on-device processing; no webcam video/image is uploaded.
When using third-party processors for payment/licensing, we disclose recipients, items processed, and retention in the Privacy Policy.
Contact bethemasterkey@gmail.com for requests under PIPA (access/correction/deletion, etc.).
15) Consent to Use
By installing or using Hivacy, you confirm that you have read and understood this Legal Notice & Disclaimer, and you accept all terms herein.
If you do not agree, do not install the app or uninstall it.
16) Changes to this Notice
We may update this Notice to reflect technical or legal changes. We will announce updates on our website or in-app at least 7 days in advance (30 days for major changes).
